Preliminary hearing held for revocation

A preliminary probation revocation hearing was held for Zachary S. Boor in the Tyler County Circuit Court on April 17.

Boor, 23, of 187 North State Route 2 Apartment C, New Martinsville, was placed on probation for two years on Nov. 17, 2011, for delivery of a controlled substance and delivery of an imitation controlled substance.

On Feb. 6, 2013, Boor was arrested in Wetzel County and charged with domestic battery which involved a minor victim. Although Boor has not been convicted of the charge, it is stipulated in the terms of his probation that he can not be arrested.

Witnesses called to the stand to testify included Chief Probation Officer John Lantz, Wetzel County Detective Donnie Harris, the child’s babysitter, and the child’s mother. The witnesses were cross-examined by Defense Attorney Justin Craft and Prosecuting Attorney Luke Furbee.

After hearing testimony, Judge Mark A. Karl scheduled an adjudicatory hearing for May 2 where it will be determined if the evidence supports the allegations. Karl denied Craft’s previous request for Boor to post bond.

Also appearing in court was Marvin E. Parrish. Parrish, 51, was convicted on sexual abuse charges in 2005 and requested a sentence reduction or even the possibility of probation on April. He is currently serving two consecutive 10 to 20 year terms in the Mount Olive Correctional Center for sexually abusing a female juvenile.

Karl had not yet reached a decision and said he would file a ruling in seven to 10 days.

A capias was issued for the arrest of Ronald A. Morgan III, 36, of HC 60 Box 92, Pine Grove, who was scheduled to appear for a Rule 404B evidence hearing. After his arrest, he will be scheduled to appear on May 2 at 10 a.m. Morgan is charged with two counts of grand larceny, conspiracy to commit an offense against the state, and destruction of property.

Dwayne Ueltschey, 34, of 40031 State Route 26, Woodsfield, Ohio, is scheduled to appear again in court on May 24 at 1:30 p.m. He is charged with seven counts of forgery and two counts of uttering.

The following cases were continued until May 2 at 10 a.m. :

–Daniel S. Finley, 25, of 201 Dodd St. Lot 4, Middlebourne, is charged with sexual assault in the third degree.

–Kae L. Cornell, 40, of 42 South Third Avenue, Paden City, is charged with five counts of uttering.

–Curtis Lemasters, 27, of North Second Avenue, Paden City, is charged with third offense or subsequent offense of driving while his license was revoked for driving under the influence of alcohol and second offense driving under the influence.

–David A. Beaver, 22, of 230 Wood Street, Sistersville, is facing a possible probation revocation.

–Zachary J. Ferrebee, 23, of 604 North Sixth Avenue, is facing a possible probation revocation.
