Headley pleads guilty to charges

Gary Todd Headley appeared before Judge David W. Hummel Jr. in the Tyler County Circuit Court on Friday, Nov. 30 to accept a plea agreement.

Headley, 32, of HC 62 Box 100, Jacksonburg, was represented by Attorney Phillip Bowser. He pleaded guilty to three felony offenses: two counts of sexual abuse in the first degree and attempted incest, the latter which was brought forth by way of information on Nov. 30.

On July 3, Headley allegedly attempted to engage in sexual intercourse with a minor under his care by entering their bedroom and inappropriately touching them under their clothes.

“That night, I had been drinking and I was pretty drunk and there was some inappropriate touching that night that I should have never done,” said Headley.

For each charge of sexual abuse in the first degree, Headley was sentenced to one to five years. For the charge of attempted incest, he was sentenced to one to three years. The sentences are to be served consecutively in the West Virginia Penitentiary for Men, which results in a sentence of three to 13 years.

Headley is ordered to still be financially obligated to the minor. Upon his release, he will be under supervised release for 10 years and must also register as a lifetime sex offender.

Headley was originally served a five count indictment by the October term of the grand jury which consisted of three counts of sexual abuse by a custodian, which were dismissed, and two counts of sexual abuse in the first degree.

Headley was remanded to the North Central Regional Jail to be transferred to the Division of Corrections.
