Paden City Man Sentenced to 1 Year on Grand Larceny Charge, Given Credit for 195 Days Served
James Michael Summers, 46, of Paden City pleaded guilty to an information count of grand larceny during a hearing before Wetzel County Circuit Court Judge Richard Wilson on Oct. 29.
As part of the plea, Wilson sentenced Summers to one year in jail with credit for time served. Since he had already served 195 days in jail, Summers was to be released that day.
In West Virginia, prisoners are required to serve at least half of their sentence before being considered for release. Since Summers already served more than half of a 365-day sentence he could be released without serving any additional jail time.
Summers was also ordered to pay $1,000 in restitution to the victim in the case as two of the stolen firearms were never recovered. Wilson ordered that Summers pay back the victim within 90 days. His attorney Roger Curry suggested that he be given six months to pay restitution. Wilson suggested that the money Summers would have spent on his previous cigarette smoking habit be used toward paying the restitution.
Wetzel County Prosecutor Tim Haught said had the state gone to trial, evidence would have shown that Summers, with the help of accomplices, took possession of stolen firearms.
Haught noted there is one person to be charged in the same incident, while another person is being charged in federal court.
