Judge Jeffrey D. Cramer Hears Tyler County Court Cases

Seth M. Morris age 32, of 107 Leon St. Paden City appeared in person with his attorney Kevin Neiswonger and Prosecutor Luke Furbee appearing on behalf of the state. Morris appeared for a pre trial or entry of a plea for charges of count one felony Burglary, count two felony Destruction of Property, count three felony Entry of Building other than dwelling, count four felony Strangulation, count five misdemeanor Domestic Battery, count six misdemeanor Unlawful Restraint, and count sever misdemeanor Destruction of Property all alleged to have occurred on or about October 13, 2020. Morris waived his right to a speedy trial this court term and was remanded back to jail. He is scheduled to return February 15,2022 to enter a plea.

Arthur J. Carr age 34, of 4623 Brushy Fork Rd. West Union, appeared in person with counsel Kevin Neiswonger for a status hearing. Carr faces one count Burglary and one count Domestic Battery second offense alleged to have occurred on or about April 1, 2021. Mr. Carr waived his right this court term. His bond continues and is scheduled to return March 10th for trial.

James R. Burras age 42, of 286 Carter St. Sistersville appeared in person along side his counsel Dean Williams. Burras was originally charged on or about June 8, 2021 for the alleged charges of count one Possession of a controlled substance with intent to deliver – marijuana. and one count Possession of Controlled Substance. Burras plead guilty to the lesser charge of Possession of marijuana and the secondary charge was dismissed. Burras was given credit for time served and was remanded back to jail to continue out the remainder of sentencing.

Brittany N. Baker age 29, of 318 South Chelsea St. Sistersville appeared in person with her attorney Kevin Neiswonger for a motions/ pre trial. Baker is charged with two felony counts of Possession of a Controlled Substance Methamphetamine and Marijuana. Miss Baker waived her right to a speedy trial this court term. Judge Cramer continued the pre-trial due to the officer being at the WV State a police Academy and being unable to testify. Baker is schedule to return to court on February 15, 2022 for a status hearing.

Skyler N. Cathers age 22, of 215 Elizabeth St. Sistersville, WVa. Appeared in person with counsel Kevin Neiswonger for a motions pre trial hearing. Cathers was remanded back to jail and is scheduled to return February 15, for a motions hearing. At this same time Judge Cramer called Taylor R. Reed am alleged co- conspirator with Cathers. Judge Cramer ordered both parties to return on March 14,2022 for trial date.

James S. Barnhart age 31, of 640 Maple Ave. Apt. # 2 New Martinsville appeared in person with attorney Howard Klatt for petition to revoke home confinement. Barnhart’s home confinement was revoked and he was remanded to jail to serve out his original sentence.

April D. Eddy age 47, of 3612 Sellers Rd. Middlebourne, WVa appeared in person with her counsel Dean Williams for a plea hearing. Eddy was originally charged on or about October 12, 2021 for one count felony of forgery. Eddy is alleged to have forged a doctors script belonging to the Nurse Practitioner Patricia Bowman excusing her from jury duty in Tyler county. Eddy entered a plea agreement of guilty with the state. Upon her guilty plea she will be placed on three years supervised probation. Her guilty plea will be deferred until the end of those three years. Upon completion of supervised probation her charges will be dismissed.

Gary E. Lemasters age 50, of 3612 Sellers Rd. Middlebourne, WVa appeared in person with his counsel Lynnsie Parsons for a plea hearing. Lemasters was originally charged on or about October 12, 2021 for one count felony of Uttering. Lemasters entered a plea agreement of guilty with the state. Upon his guilty plea Lemasters will be placed on three years supervised probation. His guilty plea will be deferred until the end of those three years. Upon completion of supervised probation his charges will be dismissed, provided the plea agreement is followed and there are no issues with the probation office during the three years supervision.

Edwin T. Perez Jr. age 21 of 296 North St. Rt2 Apartment #12 New Martinsville appeared with counsel Lynnsie Parsons. Perez was charged with one count misdemeanor fleeing from officer in vehicle. Perez entered into a plea agreement with the state and plead guilty. The plea agreement sentences Perez to 90 days in jail with credit for time served, $500 fine and the fees for counsel. Judge Cramer ordered Perez to self report to North Central Regional Jail by 4:00 p.m. on February 4,2022, to fulfill his remaining 29 days of sentencing.
