Administrative Order Regarding Tyler Grand Jury

Please take notice that the convening of the June 2020 Term of the Grand Jury scheduled for Tuesday, June 9, 2020, in the Circuit Court of Tyler County, West Virginia, is continued and adjourned.

Due to the ongoing COVID-19 pandemic, the Administrative Order entered by the West Virginia Supreme Court on March 16, 2020, the subsequent Amended Administrative Orders entered by the West Virginia Supreme Court thereafter and the most recent Administrative Order relative to Resumption of Operations (all of which relate to the COVID- 19 pandemic), various Executive Orders entered by West Virginia Governor Jim Justice, and the uncertainty as to dates when mass gatherings will be permitted again in West Virginia, pursuant to the authority granted to this Court by W.Va. Code 52-2-1, the Court dispenses with the Tyler County Grand Jury for the June 2020 Term scheduled for June 9, 2020, and continues and adjourns it from that date.

In the event that there is a resumption of normal court operations, the Court may, at a special, regular or adjourned term thereof, whenever it shall be proper to do so, order a grand jury to be drawn and to attend the June 2020 term.

A grand jury summoned to attend a special, regular or adjourned term may consider any offense against the laws, whether the same shall have been committed before the next preceding term of the court or not, and whether the accused shall have been held for trial or not prior to the next preceding regular term. It is so ordered.

It is further ordered that the Clerk of Tyler County shall provide an attested copy of this Administrative Order to the Tyler County Prosecuting Attorney, The Honorable Judge Cramer, and any other interested parties as well as to conspicuously post a copy of this Administrative Order within its office.
