Jeremy M. Keller, 35, of Third Street, Middlebourne, appeared in Tyler County Circuit Court on July 29, for formal arraignment on two separate felony charges received as part of a 98-count indictment returned by the June grand jury.

In count one of the indictment Keller is alleged to have committed the felony offense of conspiracy to commit an offense against the state, to have occurred between October 2012 and September 2013. He is also charged in count 87 of the indictment with the felony offense of possession of precursor with intent to manufacture methamphetamine, alleged to have occurred between Oct. 11, 2012, and Aug. 15, 2013.

He pleaded innocent to both charges July 29 before Judge Mark A. Karl. Keller’s attorney, Eric K. Powell, asked the court for more time to go over discovery and for bond to continue for his client. Judge Karl, with no objection from the state, granted the motion. Karl told Keller to stay in contact with his attorney and ordered him to return to court on Aug. 7.

Ryen M. Archer, 22, of Dodd Street, Middlebourne, appeared before Judge Karl for formal arraignment alongside his court-appointed attorney, Matthew Graves. Archer is charged in 12 separate counts of the special 98-count indictment. Count one charges him with the felony offense of conspiracy to commit an offense against the state. Count six of the indictment charges him with the felony offense of operating or attempting to operate a clandestine drug laboratory. Counts 78 through 87 of the indictment charge Archer with the felony offenses of manufacturing of a controlled substance alleged to have occurred between July 2013 and September 2013. Count 90 charges him with the felony offense of possession of precursor with intent to manufacture methamphetamine, alleged to occur on or between Feb. 14 and Aug. 26, 2013.

Archer, pleaded innocent to all charges before Judge Karl and Graves asked Karl to defer the case to allow him time to go over discovery. Karl deferred the case until Aug. 21. He ordered Archer to stay in contact with his attorney and to return to court on that date. Bond in his case was allowed to continue.

Joshua R. Smith, 29, of South Chelsea Street, Sistersville, appeared in court July 29 for further proceeding on two charges handed down against him by the June grand jury. Smith was arraigned on the charges on July 3, and at that time pleaded innocent to both charges.

He is accused in the 50-count indictment with two felony drug related crimes. Count one charges him with conspiracy to commit an offense against the state and count 48 charges him with the felony offense of possession of precursor with intent to manufacture methamphetamine. Both are alleged to have occurred in Tyler County between October 2013 and February 2014.

His attorney, Kevin Neiswonger, requested discovery and also asked that bond be allowed to continue for his client. Judge Karl passed the case until Aug. 21. He told Smith to stay in contact with his attorney and allowed his bond to continue. He was ordered to return to court Aug. 21.

Clifford Jackson Jr., 53, of South State Rt. 2, Sistersville, appeared in court alongside his attorney, John Butler, for further proceedings. He is charged in an indictment from the June term of the grand jury with

three separate felony offenses of delivery of a controlled substance (Vicodin). They are alleged to have occurred on March 23, April 8, and April 10. At his last appearance on July 3, Judge Karl, entered an innocent plea on Jackson’s behalf as he stood silent before the court. His attorney Butler asked the court to grant a discovery motion and allow bond to continue. On July 29 Butler again asked the court for more time to go over discovery and to allow Jackson’s bond to continue.

Karl passed the case until Aug. 21. He told Jackson to remain in contact with his attorney and allowed his bond to continue.

Richard D. Hooks, 40, of Rippentuck Road, Friendly, was not in court because he was working in Pennsylvania. Hooks is charged with the felony offense of third-offense driving under influence of alcohol, alleged to have occurred on Nov. 22, 2013, in Tyler County. He was represented by his attorney, Neiswonger, who told the court there are ongoing negotiations with the state and he had spoken to Prosecutor Luke Furbee to let him know his client would not be in court that day, He said they are trying to resolve the matter and asked the court to continue to another time. Judge Karl allowed his bond to continue and ordered a return date of Aug. 21.

Douglas R. Kimball, 37, presently incarcerated, was in court July 29 for further proceedings in his case. Kimball previously pleaded not guilty to the charge of possession of a controlled substance with/intent to deliver. He is represented by his court appointed attorney Brent Clyburn, who told the court there was a misunderstanding about the discovery conference and he hadn’t received anything.

He asked the court to allow a discovery conference, subject to the rules. Judge Karl granted the motion and ordered that it may be done by mail. Kimball was remanded back to jail and ordered to return to court on Aug. 21.
