A New Martinsville woman appeared in Tyler County Circuit Court on March 18 for violating the terms of her probation.

While serving on probation for a 2012 conviction of daytime burglary, Brandie R. Forrester, 28, of 807 Ironton Street, New Martinsville, was charged with four theft-related crimes during a three-month period.

Two of the charges occurred in Tyler County and the remaining in Wetzel County.

Forrester admitted to all charges and explained that she was attempting to correct her actions. She sought counseling for Kleptomania and Post Traumatic Stress Disorder.

Both Prosecuting Attorney Luke Furbee and Chief Probation Officer John Lantz expressed to Judge Mark A. Karl that they did not feel that Forrester was a suitable candidate for probation.

“In a matter of three months, there was charges of shoplifting, three separate counts out of Sistersville. She followed that up in January with another shoplifting arrest in New Martinsville, and while this petition was filed before this court she was arrested for yet another shoplifting in Wetzel County,” said Lantz. “I just don’t feel that she’s suitable for probation and I don’t think there is any amount of counseling whatsoever that is going to prevent her from continuing to steal.”

Judge Karl agreed with both Lantz and Furbee.

“What kind of a message do you think it sends if I put you back out on the street on probation? It’s a privilege, it’s not a right,” said Karl.

Forrester was sentenced to the West Virginia Penitentiary for Women for one to 10 years for the offense of daytime burglary.

Zachary S. Boor was also in appearance for a probation violation. Boor, 23, of 187 North State Route 2 Apartment C, New Martinsville, was placed on probation for two years on Nov. 17, 2011, for delivery of a controlled substance and delivery of an imitation controlled substance.

On Feb. 6, 2013, Boor was arrested for domestic battery in Wetzel County.

Karl scheduled a preliminary hearing for witnesses to testify on Boor’s behalf on April 4 at 10 a.m.

Damien E. Baker, 19, of 407 Dodd Street, Middlebourne, pleaded guilty to breaking and entering a building other than a dwelling, petit larceny, and accessory after the fact. Per terms of his plea agreement, the charge of destruction of property was dismissed. Baker was placed on two years probation. He was fined $100 and will pay decretal judgments in the amount of $20 and pay $130.53 in restitution.

Also sentenced was Andrea D. Miler and Charles K. Hannah.

Miller, 26, of 213 Oil Ridge Road, Sistersville, was placed on probation for two years for the charge of manufacturing a controlled substance.

Hannah, 24, of 1108 Freeman Switch Road, Berryville, Ark., pleaded guilty to third offense driving under the influence. The sentence of one to three years in the West Virginia Penitentiary was imposed and Hannah was placed on home confinement.

The following cases were continued until April 4 at 10 a.m.

-Kae L. Cornell, 40, of 42 South Third Avenue, Paden City, is charged with five counts of uttering.

-Telma M. Morgan, no age or address, is charged with grand larceny.

-Curtis Lemasters, 27, of North Second Avenue, Paden City, is charged with third offense or subsequent offenses of driving while his license was revoked for driving under the influence of alcohol and second offense driving under the influence.
