Company accused in W.Va. work death seeks US court

CHARLESTON, W.Va. (AP) — A pipeline company wants a lawsuit filed by the wife of a Louisiana man who was killed by a 7,000-pound section of pipe in Brooke County moved to federal court.

The State Journal (http://bit.ly/1qNYZtR ) reports that Jennifer McDannell is seeking unspecified damages for the Dec. 16, 2012, death of her husband, Robert. He was killed when the pipe crashed through the cab of the excavator he was operating near Bethany, striking him in the chest.

McDannell's lawsuit alleges there was no protective screen in front of the cab and that the load was unsecured and unstable.

Precision Pipeline is the target of the lawsuit. It wants the civil action moved to federal court.
