Magistrates hear cases

Magistrates John Roberts and Michael Griffin heard the following cases in Tyler County Magistrates court recently.

Eva Denise Rose, 48, 193 Temple Court, Sistersville, appeared before Magistrate Michael Griffin in Tyler County Magistrate Court on March 12. Rose was facing four separate charges after having an accident on state Route 2 near Friendly. She was charged with no-proof of insurance, driving on a suspended license (non-DUI), failure to report a traffic accident, providing false information to an officer.

Rose who had a prior conviction on Aug. 31, 2012, for driving on a suspended license and unpaid citations, entered a plea of guilty to three of the new charges and had one charge dismissed. She was fined $200, plus $160.25 costs for no proof of insurance, $300 plus $160.25 costs for driving on suspended license non-DUI, and $100, plus $160.25 costs for failure to report a traffic accident. The charge of providing false information to an officer was dismissed.

The above charges occurred on Jan. 13 in Tyler County.

Glen Jordan, 29, of 300 N. Wells St., Sistersville, was in magistrate court on March 12 for a pre-trial hearing on charges of domestic battery and cruelty to animals.

The offenses were to have occurred in Sistersville on Jan. 17. Jordan pleaded guilty to the charge of domestic battery and was sentenced to 365 days in jail, with credit for time served (one day).

His sentence was suspended and he was placed on 12 months unsupervised probation. He was also ordered to make restitution of $77.12 and pay costs and fees of $160.25. The cruelty to animal charge against Jordan was dismissed.

The case against Wayne Quinn, 43, of 130 S. 3rd Ave. Paden City, charges him with violating a protective order, alleged to have occurred on Jan. 24 in Paden City.

The matter, which had been set for a pre-trial on March 19, has been continued. Quinn is under a $500 personal recognizance bond.

Lisa Gaye Lowe, 46, of P.O. Box 219, Moundsville, W.Va., appeared on March 18 to face a charge of domestic battery to have occurred on Jan. 30 at the Wells Inn in Sistersville.

She pleaded guilty to the charge before Magistrate Roberts and was ordered to pay costs and fees of $160.25. She was given credit for two days jail time.

Joshua E. Toothman, 28, of 582 Hickman Run Road, Sistersville, was charged on Jan. 5 with three separate charges: domestic assault, domestic battery, and restraining an individual against her will. The offenses are alleged to have occurred in Sistersville. Bond has been set at $15,000 and the case has been continued until April 22, when a pre-trial hearing will be held.

Matthew Glen Wright, 46, of 305 East St., Sistersville, is charged with second-offense domestic battery alleged to have occurred on Feb. 10 in Sistersville. Wright pleaded guilty on March 11 before Magistrate Griffin and was ordered to pay $160.25 costs and fees.

Eddie Pinkerton, 29, of P.0. Box 35, Belmont, W.Va., has a pre-trial hearing scheduled for April 1 on the the charges of DUI and driving left of center. The offenses allegedly occurred on Feb. 8 in Paden City. He was charged when a Paden City police officer allegedly observed him cross the center line on three occasions. He is free on $700 bond.

Jesse Oscar Bates, 24, of 28 Rose St., Lot 41 North, New Martinsville, is scheduled for a pre-trial hearing on April 1 to face charges of second-offense DUI and second-offense driving on suspended license. Both offenses are to have occurred on Feb. 25 in Sistersville, when he was allegedly observed by a Sistersville Police Officer being left of center three times. He is under a $2,000 bond.

Charles Alden Carse, 19, of Rt. 1, Box 573 Hickory Rd, Middlebourne, is charged with the following felony offenses: two counts of forgery, five counts of conspiracy to commit forgery, and seven counts of conspiracy to commit uttering. All the offenses are alleged to have occurred from Jan. 13-24. A hearing was held March 11 and the charges have been transferred to Tyler County Circuit Court.

Stephen Postlewait, 23, of 2933 Haddox Run Road, Pennsboro, W.Va., is charged with the felony offense of child abuse causing injury, alleged to have occurred on Jan. 8 in Sistersville. The case was transferred from magistrate court to circuit court and his bond of $5,000 continues. The charges are a result of the child being taken to Sistersville Hospital with multiple bruises on the face and head and a large bruise on the left forehead above the temple.

Stephen C. Hicks, 30, of 230 Wood St., Apt. 103, Sistersville, appeared before Magistrate Roberts on March 19. He was charged with possession of synthetic marijuana after Sistersville Police Officer David Northcraft was given permission to search his residence. Without entering a judgement of guilt and with the consent of the accused, Magistrate Roberts sentenced Hicks to six months probation and ordered him to pay costs and fees of $160.25.

Timothy Richeson, 26, of 230 Wood St., Sistersville, was charged on March 14 with the unlawful possession of a controlled substance, less than 15 grams of marijuana. He was charged after the Sistersville Police Department was investigating drug activity at Timber Ridge Apartments in Sistersville. He appeared before Roberts on March 18, where bond was set at $1,000 cash/surety. A hearing will be set in the matter.

Kimberly Anne Campbell, 33, of HC 60 Box 276, Pine Grove, was charged on March 7 with speeding, 70 in 55 zone, near Long Reach on state Route 2. A pre-trial hearing in the matter has been set for April 23 in Tyler County Magistrate Court.

Rhett V. Koslasky, 31, of 510 Main St., Pennsboro, is charged with domestic battery after a fight in Paden City allegedly left the victim bloody and in severe pain. The alleged offense occurred on Feb. 10 at the Paden City Apartments in the Tyler County portion of Paden City. Koslasky, who is under a $10,000 bond, was scheduled for a hearing in magistrate court on March 19. On a motion by his attorney, George J. Cosenza, the case was continued until April 10.

Shirl Norman Baker, 34, of 103 Temple Circle Drive, Sistersville, is charged with the felony offense of operating a clandestine lab. The offense allegedly occurred at his residence in Tyler County on Feb. 28. Baker remains incarcerated pending a $50,000 cash/surety bond after a hearing in magistrate court on March 26. His case was transferred to Tyler County Circuit Court.

Jason Todd Shepherd, 30, of 407 Stealey St. Middlebourne, who is charged with felony intimidation/retaliation of a witness and misdemeanor possession with intent to deliver a controlled substance, Suboxone, appeared in magistrate court on March 20. Shepherd’s case has been transferred from magistrate court to circuit court. He is free on a bond of $15,000 on one charge and $10,000 on the other, The alleged offenses occurred on March 4 in Middlebourne.

Melissa Shepherd, 26, of 407 Stealey St., Middlebourne, is charged with misdemeanor possession of a controlled substance with intent to deliver, alleged to have occurred on March 4 in Middlebourne. She is currently free on a $10,000 bond. She is scheduled to appear in magistrate court for a hearing on April 23. The charges stem from the execution of a search warrant at her residence.
