MOUNT NEBO, W.Va. (AP) — A 28-year-old West Virginia man and his 21-year-old stepdaughter have been charged with incest.
The charges were brought in Nicholas County last week, even though they are not related by blood and both are above the legal age of consent.
The Daily Mail (http://bit.ly/1bifWpV) says county authorities cited the definition of "daughter" in state law in bringing charges against the two.
Nicholas County Sheriff David Hopkins said it doesn't matter that Kelcey Nicholas and his stepdaughter, Lataura Jarrett, are not related biologically. He said Jarrett has referred to Nicholas as "father."
Before the two were charged, county officials researched state law regarding incest and consulted with the county prosecutor. They all agreed both should be charged.
It is not clear if either has an attorney.
