Original sentence is reinstated

A Middlebourne man was ordered to serve a one- to five-year sentence in the West Virginia State Penitentiary for Men after his probation was revoked in Tyler County Circuit Court Tuesday.

John VanCamp, 40, of 313 Main St., returned to court after being incarcerated in the North Central Regional Jail for allegations of parole violations to have occurred April 22. According to the complaint filed by Tyler/Wetzel Adult Probation Office John Lantz, the defendant was found in the company of a known felon and to have been in possession of drug paraphernalia.

At that time, VanCamp was taken into custody without bond.

Prior to the alleged offense, the defendant was in court for another alleged probation violation. On Feb. 1, results of the test indicated a positive result for amphetamines. A confirmation test was ordered and reported on Feb. 12 that the result was confirmed for methamphetamines.

Defense Attorney Keith White asked Tyler County Circuit Court Judge Mark Karl for leniency based on a year-and-a-half’s drug tests all recorded as negative. Further, he indicated his client was currently seeking drug abuse counseling.

“The problem I have with this is looking back at the statement signed on the drug usage papers indicated the defendant did not take prescription drugs nor did he have a problem with drugs and did not wish to seek counseling,” Karl said. “Now, facing the penitentiary, he suddenly wishes to undergo counseling.

“I am not inclined to grant the request,” he said.

VanCamp was originally sentenced to the West Virginia Penitentiary for Men for a period of one to five years for the offense of conspiracy to deliver methamphetamines, a schedule II controlled substance. That sentence was suspended and the defendant was placed on probation for a period of three years from Sept. 7, 2006, to Sept. 7, 2009. The defendant was also sentenced to 120 days in jail as a condition of probation.

He will receive credit for time incarcerated and was remanded.

Sharing the afternoon docket was Ralph J. Kasper, 54, formerly of Friendly and currently incarcerated at the NCRJ, returned on a motion to reconsider. Matters were continued when Attorney Keith White reported key witnesses were unable to attend.

The defendant was sentenced to one- to three-years in the NCRJ for driving under the influence and related charges Nov. 15, 2007, after his alternative sentencing was rescinded for allegedly being intoxicated when he arrived at the Tyler County Sheriff’s Office for home confinement hook up.

According to reports, Kasper recorded a .240 on a breathalyzer test.

He was ordered to return June 10 at 1 p.m.
